- El presidente Felipe Calderón anunció que el nuevo Centro Turístico Integralmente Planeado se ubicará al sur de Mazatlán, Sinaloa, y será el proyecto "más importante de turismo en los últimos 25 años y de las primeras dos décadas del siglo XXI".Al inaugurar la Expo Mexicana de Inversión Inmobiliaria y Turística 2008, expuso que pese a la delicada situación financiera y económica en el mundo el turismo en México está saliendo adelante y se avanza por el camino correcto.En el Centro de Exposiciones Bancomer, el mandatario destacó los indicadores positivos en materia turística y subrayó que en este año México ha recibido más de 13 millones de turistas que representan un incremento de más de cinco por ciento respecto al año pasado.Expuso que durante los primeros siete meses del año ingresaron al país ocho mil 400 millones de dólares por concepto de gasto sobre todo de turistas internacionales, seis por ciento más que en el mismo periodo de 2007.Apuntó además que con más de dos millones 200 mil empleos registrados en el sector turístico se siguen creando oportunidades para más mexicanos.Acompañado por los gobernadores de Sinaloa, Quintana Roo, Baja California y Nayarit, así como los secretarios de Turismo, Economía, Desarrollo Social, Comunicaciones y Medio Ambiente, anunció de manera formal el proyecto del centro integral de la costa del Pacífico.Se trata del proyecto "más relevante que se haya realizado en México impulsado por el sector público; se trata del proyecto más importante de turismo en los últimos 25 años y de las primeras dos décadas del siglo XXI".Calderón Hinojosa explicó que ese proyecto de desarrollará en Sinaloa, al sur de Mazatlán -en Teacapán, Escuinapa- y será un polo turístico de impacto nacional e internacional.Ese centro integral del Pacífico, cuya superficie turística será del doble de la de Cancún, estará por su importancia a la altura de los principales espacios vacacionales del mundo.Según las proyecciones del Fondo Nacional de Fomento al Turismo (Fonatur) para 2025 se prevé recibir casi tres millones de turistas, generar 78 mil empleos directos e indirectos y captar divisas por casi tres mil millones de dólares; se trata sin duda "de una gran oportunidad de negocios".Por parte del gobierno federal se apoyará con una inversión pública de casi cinco mil millones de pesos para el desarrollo del proyecto, y se tiene contemplado que éste a su vez detone una inversión privada de 66 mil millones de pesos.También "estamos impulsando la construcción de infraestructura necesaria para comunicar este centro con todo el país", dijo y como ejemplo recordó que hace algunos meses fue inaugurado el proyecto que moderniza el tramo carretero entre Mazatlán y Tepic.Así, detalló, "el gobierno federal ve y lo expresa con estas acciones que el turismo es un sector fundamental para el desarrollo económico sustentable y para la creación de empleos que demandan los mexicanos", por lo cual se actúa en diversos frentes para impulsar su crecimiento.En primer lugar, indicó, se generan las condiciones adecuadas para la inversión, al mantener la estabilidad económica a pesar del entorno internacional adverso.Eso ha promovido una entrada de inversión privada de casi siete mil 800 millones de dólares en el sector turismo en lo que va de esta administración, cifra que representa 40 por ciento de la meta sexenal, señaló.Además se impulsa la infraestructura que permita ser más accesible los centros turísticos, y para 2012 se habrán construido al menos tres nuevos aeropuertos y ampliado otros 31.Aseguró que en materia de turismo como en muchas otras áreas "México avanza", por lo que exhortó a los empresarios a invertir en el país pues "pueden estar seguros que el gobierno federal seguirá impulsado políticas públicas en materia turística".Políticas, agregó, que tienen qué ver con estabilidad económica, certidumbre jurídica, respeto al Estado de derecho y que se traduzcan en más inversión, infraestructura y empleos para los mexicanos.Al principio del discurso del mandatario una activista de Greenpeace, con una gabardina que se intentó quitar, mostró por unos segundos una pequeña pancarta con la leyenda: "No al turismo depredador".La joven fue retirada del lugar, pero al término del acto, con un bikini y tacones negros, ya sin la gabardina, se colocó en el exterior del centro Bancomer con la misma pancarta. A Company will build 4 Towers on the Malecon
With an investment of 30 million dollars Proa Group will start in November of 2008 the construction of the complex of condominiums “Breath Mazatlan” which will consist of 4 towers of 16 floors in each building with total of 144 units.

Construirán 4 torres en el malecón
Con una inversión de 30 millones de dólares, Grupo Proa iniciará, en noviembre, la construcción del complejo de condominios Breath Mazatlán, que constará de 4 torres de 16 pisos cada una y un total de 144 unidades.
El complejo estará ubicado entre el Hotel Aguamarina y la Torre Azul, sobre el malecón en un terreno de una extensión de 8 mil metros cuadrados, mencionó Francisco Prieto, arquitecto e inversionista de Breath Mazatlán.
Ayer sostuvo una reunión con el Alcalde Jorge Abel López Sánchez para formalizar el inicio de obra y acordar fecha para la colocación de la primera piedra de Breath Mazatlán que podría realizarse en la primera semana de noviembre.
Señaló que contará con 250 cajones y un entrepiso, que es donde están las áreas comunes, cafetería, gimnasio, salón común, entre otros beneficios.
"Ya se ingresó la licencia, ya se cumplieron con todos los requisitos que marca el Ayuntamiento, factibilidad de agua potable y alcantarillado. Además se formalizó el arranque de obra que se tendrá en dos o tres semanas", señaló Prieto.
"Primero tendremos la caseta de ventas, vamos a limpiar el terreno y en noviembre iniciará la cimentación de las torres. Se va a construir todo de un jalón, se construirá en una sola etapa, las 144 unidades al 100 por ciento y pensamos terminar en 24 meses".
El proyecto tendrá la cualidad de ser un desarrollo amigable con el medio ambiente, dijo, por ello privilegiarán las áreas verdes, incluso en el techo de la construcción.
Explicó que se denomina proyecto verde porque el 60 por ciento del área será verde, contará con una planta de tratamiento de agua y contará con una certificación de autosustentabilidad internacional denominada Leadership in Energy an Enviromental Design.
"Es un edificio que afecta al medio ambiente lo menos posible. Esta certificación obliga a que desde el primer día todo está documentado que son materiales reciclados. Lo que pide Leed es que el consumo de energía sea eficiente", indicó.
"Nada del agua de uso sanitario se perderá, pasará por una planta de tratamiento para ser reutilizada en el riego de áreas jardinadas e incluso de la azotea del edificio".
Se prevé que contará con 42 mil metros cuadrados de construcción, por lo que ofrecerán una importante oferta laboral.
"Todo lo hemos desarrollado en México, desde hace tiempo habíamos estado negociando construir aquí y con posibilidades como lo queríamos, principalmente en el malecón. La idea era hacer un desarrollo que fuera auténtico y el malecón nos da eso", agregó Prieto.
Los precios de los departamentos irán desde los 150 mil a los 500 mil dólares.


PROYECTO VERDE:
Grupo Proa, que está integrado por cinco inversionistas del Distrito Federal, construirá en Mazatlán un proyecto al que le llaman "verde", porque desde el inicio tendrá una certificación de autosustentabilidad internacional.

* Se harán cuatro torres.

* Entre todas sumarán 144 departamentos.
* Habrá un espacio para 250 cajones de estacionamiento, cafetería, gimnasio y salón común.

Title Insurance

Title Insurance is not required in Mexico but, it is very strongly recommended. The policy is a “contract of indemnity” that guarantees a purchasers ownership rights and lien interest as established in the public deed (escritura publica). This policy insures the purchaser against any loss suffered by a defect or cloud on title. The policy is the only guarantee that any buyer or lender can receive that protects their rights of ownership or lien priority as recorded in the Mexican public registry of property and commerce. There are two title companies with a good solid reputation for doing business in Mexico and they are Stewart Title Company and First American. They apply a United States standard of title insurance on property by performing an extended title search (non-standard by Mexican Practice) and obtaining all relevant documents in the chain of title. They have more than 110 years of real estate experience in the United States and are traded on the New York Stock Exchange.

Notario Publicos are very good but they do not provide any type of guarantee in the event of a defect on title. They do not have the financial responsibility to pay the property owner or lender in the event they suffer a monetary loss due to fraud, impersonation, misrepresentation, recording error, litigation against the seller, a prior owner, a missed lien, encumbrance, and/or a secret heir or undisclosed spouse.

The insurance policy is a onetime premium payment and the policy stays in full force and effect for as long as the purchaser owns the property. The company that issues the policy has the legal responsibility to defend the insured customer against any claims, losses, or lawsuits filed against the insured title holder. Normally they will respond within 30 days of any claim against title.

5 billions project for *CIP Costa del Pacífico

The development of the first Center Integrally Planned of Sinaloa that will take for name Costa del Pacífico will need a total investment of $ 5,225 million pesos according to the offer of the National Fund of Promotion to the Tourism.(FONATUR)
For the CIP, which will be located on the coast that goes of Rosario to Teacapan, Fonatur raised to the Deputies' Chamber an investment of $ 1’157,000.00 million pesos next year, according to the Project of Budget of Expenditures of the Federation presented to the legislators on Monday. In the document there is described that the Integrally planned Center will develop 154 lots in which it will be Touristic Resorts, Hotels, Residential and Urban Housings, Beach Clubs, Golf Courses, Marina and Malls among others.
This 2008 estimated an investment in the zone of $ 476 million pesos, for the preparations of the project, and more or less similar quantities are foreseen after 2009. For the next year there would be destined the highest sum of the project with which it will start in form this development, which will rely on an infrastructure similar to that of other centers integrally planned like it was Cancun and Nuevo Vallarta.
A source of the Secretariat of Tourism confirmed that the project will be called Costa del Pacífico and that it might be announced of official form next week by the Governor Jesus Aguilar Padilla.
The Government of the State today there does public that they will initiate the works for the production of Rosario-Teacapán's Regional Plan, as part of the State Program of Urban Development and launches the summons for the public consultation of this plan.
He indicates that the interested parties will be able to take part in the urban and tourist development of the State, they can present offers from today until November 9, 2008; and the offers will have to appear in the administrative agencies of the State.

5 billions project for *CIP Costa del Pacífico

The development of the first Center Integrally Planned of Sinaloa that will take for name Costa del Pacífico will need a total investment of $ 5,225 million pesos according to the offer of the National Fund of Promotion to the Tourism.(FONATUR)
For the CIP, which will be located on the coast that goes of Rosario to Teacapan, Fonatur raised to the Deputies' Chamber an investment of $ 1’157,000.00 million pesos next year, according to the Project of Budget of Expenditures of the Federation presented to the legislators on Monday. In the document there is described that the Integrally planned Center will develop 154 lots in which it will be Touristic Resorts, Hotels, Residential and Urban Housings, Beach Clubs, Golf Courses, Marina and Malls among others.
This 2008 estimated an investment in the zone of $ 476 million pesos, for the preparations of the project, and more or less similar quantities are foreseen after 2009. For the next year there would be destined the highest sum of the project with which it will start in form this development, which will rely on an infrastructure similar to that of other centers integrally planned like it was Cancun and Nuevo Vallarta.
A source of the Secretariat of Tourism confirmed that the project will be called Costa del Pacífico and that it might be announced of official form next week by the Governor Jesus Aguilar Padilla.
The Government of the State today there does public that they will initiate the works for the production of Rosario-Teacapán's Regional Plan, as part of the State Program of Urban Development and launches the summons for the public consultation of this plan.
He indicates that the interested parties will be able to take part in the urban and tourist development of the State, they can present offers from today until November 9, 2008; and the offers will have to appear in the administrative agencies of the State.

What is a Notario?

In Mexico, the notary public (notario público) is a public official appointed by the State Governor. He has the capacity to attest and certify documents and business and legal transactions that require authenticity. He also provides for strict security of original records and documents.

Some of the requirements for becoming a Mexican notary public are as follows:

• must be a Mexican citizen
• must by thirty-five years of age
• have a law degree
• three years experience working in a notary public office
• must take and pass an examination and if he passes, in time the governor will give him an appointment.

There is supposed to be one Notario for every 30,000 citizens. The Notario not only has the power to witness and certify documents that require absolute authenticity and handles wills and business contracts, as well as real estate matters, it is required by law. If a document is not notarized by a Mexican notary public it is not legal! In addition, the Notario has the responsibility for the management and storage of original documents.

Although the Notario is a lawyer and generally selected and paid for by the buyer, the Notario won’t function as your attorney in the real estate transaction. He is responsible for being neutral and fair to all parties and cannot advise anyone involved in a transaction for which he is acting as notary.

Under Mexican law, the deed to property must be prepared by a Notario, who will ensure that all documentation and permits are in order and that there are no liens or judgments against the property, so that the transaction can proceed. He will also calculate the seller’s capital gains taxes and the buyer’s acquisition taxes. In short, everything official to do with your transaction should be done by the Notario.

Because of the responsibility and potential liability the Notario may incur, notary fees are significantly greater in Mexico than those of notaries in the USA and Canada. These fees are based on a rate schedule set by an official commission and are tied to the amount declared in the property transfer and are about 1.5% of the transaction value. There is also the 15% I.V.A. to be paid on the services.

Mexican Trust

Foreigners may acquire direct ownership of property in the interior of Mexico; however, the Mexican Constitution regulates land ownership and establishes states that “…in a zone of 100 kilometers (about 62 miles) along any border or 50 kilometers (about 31 miles) along the coast, a foreigner cannot acquire direct ownership of this land.” This zone is known as the “restricted zone” or “prohibited zone.” Foreigners must use a trust to buy property within this zone. A real estate trust must be set up to hold title for the foreigner. Since foreigners are not able to enter into contracts to hold title to real estate in the restricted zone, they must have a bank act on their behalf.

Foreign investment in these restricted areas is possible through the use of a “fideicomiso” (fee-day-e-co-me-so), which is a Mexican real estate trust that was created by the Mexican government. The “fideicomiso” has been a legal document since December 28, 1989. A Mexican bank must be nominated as the trustee and is required to hold the title to the property. The Mexican Government created the "fideicomiso" to resolve the problems involved in developing the restricted zone and to attract foreign capital. Now foreigners, as beneficiaries of the trusts, can finance land located in the restricted zone without violating the law. The trust agreement is executed between a Mexican bank and the seller of the property in the restricted zone. The bank acts on behalf of the foreign buyer, taking title to the real property. The bank, as trustee, acquires the property for the foreigner, and then has a fiduciary obligation to comply with all instructions given to the bank by the foreigner, who is the trust beneficiary. The trust beneficiary retains and enjoys all the rights of ownership while the bank holds title to the property. The foreigner is entitled to use, enjoy, rent, remodel, profit (an example of this would be selling crops), and even to sell the property to any eligible buyer. Typically, the trust has a fifty (50) year term renewable indefinitely with annual fees of about five hundred fifty United States Dollars ($550 USD). There is a common misconception among foreigners investing in Mexico that once the trust term expires, the beneficiary loses all rights and benefits of the sale of the property held in trust. On the contrary, the beneficiary has a contractual right under the trust agreement with the Mexican bank to all benefits that may result from the use or sale of that property, even though he does not hold title to the property. Under Mexican Law, the bank has an obligation to respect the rights of the beneficiary. All foreigners are required by the Mexican government to obtain a permit from the Ministry of Foreign Affairs; even though this is executed by the bank and trustee it is recommended that a foreign buyer obtain the permit before finalizing any legal binding contract. This permit can be obtained in a few days. The bank is also expected to obtain a permit from the Ministry of Foreign Affairs. The reason for this is to ensure the trust’s beneficiary is granted the right of use concerning the property.
